Who can apply?

The criteria for eligibility are set out in the Disciplinary Committee By-Laws of the CS (in French) and include:

• • Have been active as a representative for at least ten (10) years in the discipline(s) or category(ies) of registration for which a member is applying;
• • Possess exemplary professional and ethical conduct and be a reference to their peers;
• • Possess the probity and integrity necessary to serve as a member of the Disciplinary Committee;
• • Have never been the subject of a complaint filed with the Disciplinary Committee of the CSF, a professional order or an organization responsible for the supervision and control of persons acting as representatives in Quebec, Canada or abroad;
• • Have never been the subject of a revocation, suspension, refusal to renew, limitation or condition of their certificate (by the Autorité des marchés financiers (AMF));
• • Have never been subject to any suspension, delisting, restriction or condition relating to their registration (by the AMF);
• • Have never been convicted by a Canadian court of an offense or act relating to the practice of the representative’s profession;
• • Have never failed to comply with the mandatory professional development requirements of the CSF or the Regulation respecting the compulsory professional development of financial planners.

What is the composition of the Disciplinary Committee?

The Disciplinary Committee hearing a complaint shall be composed of three (3) persons, namely the Chair of the Disciplinary Committee and two (2) members who are engaged in the same discipline(s) and marketing sector(s) as the representative against whom the disciplinary complaint is made. The Chair of the Disciplinary Committee may be replaced by an alternate.

What is the role of a member of the Disciplinary Committee?

The member of the Disciplinary Committee is called upon to hear any disciplinary complaint brought against a representative overseen by the CSF and to evaluate the evidence presented to him or her in order to determine whether the representative has committed, or the actions of the representative constitute, an ethical violation. If the representative is found guilty, the member is also responsible for imposing the disciplinary sanction.

What commitment is required of a member of the Disciplinary Committee?

It is difficult to determine the number of hearings a member may be required to attend, as it depends on the disciplines and marketing areas involved in a complaint against a representative, as well as the availability of Disciplinary Committee members.

Disciplinary Committee hearings are held on weekdays and vary in length. They generally begin at 9:30 a.m.

Is a member of the Disciplinary Committee compensated for serving on the Committee?

The Regulation Concerning Salaries, Fees, and Other Compensation of Members of the House Committee on Discipline e (in French) provides for the compensation of members of the Committee on Discipline. The regulation provides for $300 per day of hearing or deliberation, and travel expenses for hearings are also reimbursed in accordance with the policy on reimbursable expenses.

How long does a member of the Disciplinary Committee serve?

Members of the Disciplinary Committee will be appointed by the Board in December 2023 and will serve for a term of three (3) years.

It should be noted that new members will not be appointed until they have completed training in their new role, which will take place in early 2024, and have signed a solemn undertaking.

Where do the Disciplinary Committee hearings take place?

Disciplinary hearings may take place anywhere in the province of Quebec but are often held in Montreal at the offices of the CSF.

It should be noted that, as of March 2020, almost all hearings are held remotely by videoconference.
